What Is The Social Security Disability Process?

  • First, you must get in touch with the Social Security Administration (SSA) via telephone. A representative will gather basic information, including your contact information, place of employment, injury and treatment history.
  • The SSA will send this information to Disability Determination Services (DDS), a state agency. The DDS will gather records from your medical providers and one of its employees will make an initial determination on your file. Many applications are denied at this stage of the process; so do not give up if you receive an initial denial.
  • After an initial denial, you have 60 days to file a Request for Reconsideration. Given this strict timeline, the best time to contact a knowledgeable Social Security lawyer is immediately after your claim is denied. At this stage, you may have to submit additional paperwork to the DDS and it will make another decision.
  • If the DDS issues a Reconsideration Denial, it is time to request a Social Security hearing so you can present your case to an administrative law judge. Again, you have 60 days to make your next move, so it is essential to work with an attorney who is experienced in hearing preparation and who knows how to present your case. The right attorney will be able to develop your case thoroughly and present a compelling argument for why your claim should be approved.
  • In the event the hearing is unsuccessful, it is possible to file an appeal with the Appeals Council.
